Northern Florida U.S. District Court 

Thomas Kent Wetherell II was born in August 1970 in Daytona Beach, Florida. He earned an undergraduate degree from Florida State University and received his Juris Doctor from the Florida State University College of Law. 

Wetherell joined the private practice of law, serving four years. He was a Deputy Solicitor General in the Office of the Florida Attorney General for two years. He spent seven years as an Administrative Law Judge in the Florida Division of Administrative Hearings and was later appointed to the Florida First District Court of Appeals by Governor Charlie Crist. 

He was nominated by President Donald Trump to a seat on the United States District Court for the Northern District of Florida. His nomination was confirmed by the Senate after a cloture vote, and he received his commission in July 2019. 

Wetherell is married to Edie and they have two children.

U.S. District Judge T. Kent Wetherell ruled the “catch and release” policy of President Biden’s administration, by which foreign nationals were allowed to remain in the country illegally rather than be deported, was unlawful and “due to be vacated.” 

The administration had filed for a summary judgment which was denied. The judge vacated the “parole+ATD” policy under the Administrative Procedures Act. The administration was given seven days to appeal and comply with federal law and his ruling. 

In his 109-page opinion, Judge Wetherell wrote, “The Court finds in favor of Florida because, as detailed below, the evidence establishes that Defendants have effectively turned the Southwest Border into a meaningless line in the sand and little more than a speedbump for aliens flooding into the country by prioritizing ‘alternatives to detention’ over actual detention and by releasing more than a million aliens into the country – on ‘parole’ or pursuant to the exercise of ‘prosecutorial discretion’ under a wholly inapplicable statute – without even initiating removal proceedings.”
