The decision upheld state laws in West Virginia and Idaho.
The Supreme Court found that state laws prohibiting male athletes who identify as transgender from participating in girls’ or women’s sports do not violate civil rights protections.
Justice Brett Kavanaugh wrote the majority opinion, stating, “[C]onsistent with Title IX and the Equal Protection Clause, we hold that the States may maintain women’s and girls’ sports for biological females. They may determine eligibility for women’s and girls’ sports based on biological sex. The Constitution and Title IX do not require an overhaul of women’s and girls’ sports throughout America.”
In 2020, Idaho was the first state to pass a law that bars the participation of male athletes on female sports teams in public schools from elementary through college. Twenty-five states passed similar bans after Idaho’s law was enacted.
