The court said the case was moot after the plaintiffs were removed from the country under another law.
The Fifth Circuit U.S. Court of Appeals dismissed a case regarding the use of the 1798 Alien Enemies Act (AEA) by President Trump’s administration to deport Venezuelan gang members. The action came after the three plaintiffs challenging that law were deported under the Immigration and Nationality Act.
Chief Judge Jennifer Elrod wrote for the en banc court, “The Supreme Court remanded this case to us when the three named petitioners were still in the country. But we have since learned that the government has removed them. Given this change, we conclude that the appeal is moot.”
The Supreme Court had determined the administration had not provided Venezuelan nationals sufficient time or information for their removal under the AEA and returned the case to the 5th Circuit to set the amount of time detainees should be given to contest deportation.
