Labor Department Clarifies English Proficiency Rules for Commercial Drivers

New guidance affects labor certification applications for foreign commercial motor vehicle operators.

The U.S. Department of Labor (DOL) issued new guidance requiring foreign workers in commercial motor vehicle jobs to meet federal English-language proficiency standards. The directive applies to temporary and permanent labor certification filings and aligns with existing Federal Motor Carrier Safety Administration (FMCSA) regulations requiring commercial drivers to read and speak English sufficiently to understand traffic signs, communicate with the public, and complete reports.

Acting Labor Secretary Keith Sonderling and Director Brian Kennedy of the Office of Foreign Labor Certification’s Office of Immigration Policy said the updated guidance is intended to improve consistency and roadway safety.

“Holding employers to existing English language proficiency requirements is critical to keeping Americans safe on our roads,” said Acting Labor Secretary Keith Sonderling.

“As part of our responsibility to review job orders and labor certification applications for compliance with federal law, the Department of Labor ensures required qualifications—such as the English language proficiency standard—are clearly stated in employer filings,” said Director Kennedy.

The Department of Labor said implementation of the guidance will begin 30 days after publication to allow employers time to review the changes.

As the Lord Leads, Pray with Us…

  • For Acting Secretary Sonderling as he oversees the implementation of English-language proficiency standards by employers for commercial drivers
  • For Director Kennedy and labor officials as they update migrant employment and transportation regulations.
  • For U.S. transportation officials as they seek to improve safety on highways and roads through commercial driving regulations.
