Supreme Court Upholds Broad Interpretation of Birthright Citizenship

The decision nullifies the president’s executive order that sought to restrict citizenship to those born to parents subject to U.S. jurisdiction.

The Supreme Court determined that President Trump’s executive order seeking to exclude children born to illegal aliens or to those with temporary legal status from U.S. citizenship was unconstitutional.

Chief Justice John Roberts wrote for the majority, “Citizenship, then and now, was the right to have rights — to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land.’ We keep that promise today.”

Justice Brett Kavanaugh concurred with the majority opinion but argued that the president’s executive order violated immigration law rather than the Constitution.

Justice Kavanaugh stated, “Consistent with the Fourteenth Amendment, Congress could amend §1401(a) or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country. But Congress has not yet done so.“
