FDA Warns Retailers Selling Illegal Tobacco Products

Agency targets products designed to resemble common consumer items and appeals to youth.

The U.S. Food and Drug Administration (FDA) recently issued warning letters to eight retailers for selling unauthorized tobacco products, including nicotine pouches and dissolvable tobacco items designed to resemble candy, breath strips, and cough drops. According to the agency, such products raise concerns about accidental ingestion by young children and may appeal to youth attempting to disguise tobacco use. The FDA stated that the products lacked required federal authorization and violated the Federal Food, Drug, and Cosmetic Act.

“No tobacco product should look like candy—it’s a blatant ploy to target children and mask the true nature of these products,“ said Acting Director Bret Koplow of the FDA’s Center for Tobacco Products. “FDA and its partners are committed to implementing an aggressive enforcement strategy to stop illegal products like these from ending up on shelves or in the hands of kids.”

Retailers were instructed to correct the cited violations and ensure compliance with federal tobacco regulations or face potential enforcement actions, including fines, product seizures, or injunctions.

The action is part of the FDA’s broader effort to remove unauthorized tobacco products from the market. The agency has issued more than 800 warning letters to firms and over 1,000 to retailers for similar violations and continues to provide resources to help businesses comply with federal requirements.
