The decision overturns the district court injunction as the environmental lawsuit is reviewed on its merits.
The 11th Circuit U.S. Court of Appeals ruled that “Alligator Alcatraz,” the immigration detainment center in Florida’s Everglades, can remain open while a lawsuit challenging its environmental impact proceeds.
This decision overturns a ruling issued by District Judge Kathleen Williams last month, which ordered the state of Florida and President Trump’s administration to immediately stop bringing illegal alien criminals to the mass detention facility and dismantle it within 60 days. The Department of Homeland Security had begun to comply with Judge Williams’ order by transferring some detainees out of the facility.
The appellate court determined that the environmental challenge lawsuit on which Judge Williams issued a preliminary injunction was unlikely to succeed.
“Alligator Alcatraz is in fact, like we’ve always said, open for business,” said Florida Governor Ron DeSantis. “The mission continues, and we’re going to continue leading the way when it comes to immigration enforcement.”
