District Judge Issues Block on Birthright Citizenship Restrictions

The Supreme Court previously restricted nationwide injunctions against presidential policies and had permitted President Trump’s limitations on birthright citizenship.

New Hampshire District Judge Joseph Laplante issued a new nationwide injunction last week against President Donald Trump’s order to restrict birthright citizenship in the United States, saying that the plaintiffs successfully demonstrated that the reversal of this policy would inflict “irreparable harm” on those born in the country after February 20, the date the policy was set to take effect.

Judge Laplante’s court order did grant President Trump’s administration seven days to appeal to the Supreme Court. President Trump’s order denying automatic citizenship to children born in the U.S. whose parents are not citizens was set to go into effect on July 27.

The Supreme Court had permitted the president’s order to go into effect in parts of the U.S. but allowed for a class action suit. However, the high court had placed restrictions on the use of nationwide injunctions by district courts.
