An administration official said the government will appeal and points out the lack of authority of a district judge to stop the administration from securing the U.S. border.
District Judge Randolph Moss issued a 128-page opinion blocking President Donald Trump’s ban on claiming asylum and humanitarian protections at the U.S.-Mexico border. Judge Moss said that the ban ignored federal law and the U.S. Constitution, though he said his ruling would not go into effect for 14 days to allow the president’s administration time to file an appeal.
“Nothing in the [Immigration and Nationality Act] or the Constitution grants the President or his delegees the sweeping authority asserted in the Proclamation and implementing guidance,” wrote Judge Moss. “An appeal to necessity cannot fill that void.”
White House spokeswoman Abigail Jackson issued a statement deriding Judge Moss’s authority over the Trump administration’s violation of federal law.
“A local district court judge has no authority to stop President Trump and the United States from securing our border from the flood of aliens trying to enter illegally,” Spokesperson Jackson said. “We expect to be vindicated on appeal.”
