Federal Judge Dismisses California Lawsuit on Tariff Authority

Cites the Court of International Trade as the appropriate jurisdiction for the legal challenge.

Northern California District Judge Jacqueline Scott Corley dismissed Governor Gavin Newsom’s and Attorney General Rob Bonta’s lawsuit against President Trump’s tariffs this week, refusing a request from President Donald Trump’s administration to transfer the case to the New York federal court.

The dismissal of this case allows the state of California to transfer the lawsuit to the Court of International Trade (CIT), which Judge Corley ruled was the correct place for the case to be resolved.

“Because California requests dismissal rather than transfer to the CIT, transfer is not in the interest of justice,” Judge Corley stated.

The California attorney general is appealing to the Ninth Circuit U.S. Court of Appeals.
