The Supreme Court ruled 6-3 in favor of police sergeant Nathan Van Buren. The FBI had charged him with fraud and with violating the Computer Fraud and Abuse Act when he conducted a license plate search using a law enforcement database in exchange for money. He was found guilty on both counts but argued that the Computer Abuse Act specifically did not apply in this case.
The Supreme Court agreed. Justice Barrett wrote for the bipartisan majority, stating that the FBI’s open interpretation of the law “would attach criminal penalties to a breathtaking amount of commonplace computer activity,” making “millions of otherwise law-abiding citizens criminals.”
