Trevor Neil McFadden was born in June 1978 in Alexandria, Virginia. He earned an undergraduate degree from Wheaton College in Illinois and received his Juris Doctor from the University of Virginia School of Law. He clerked at the U.S. Eighth Circuit Court of Appeals. 

He was an Assistant United States Attorney in the District of Columbia and served as counsel to the United States Deputy Attorney General. He also has experience as a law enforcement officer. He spent four years in private practice. He served as Deputy Assistant Attorney General in the Criminal Division of the Department of Justice. 

McFadden was nominated by President Donald Trump to serve on the United States District Court for the District of Columbia. He was confirmed by the Senate and received his commission in October 2017. 

He is an Anglican. 

In the News…

U.S. District Judge Trevor McFadden denied the request for a preliminary injunction from three Stars and Stripes journalists who sought to remain employed by the media outlet as their case proceeds. They have sued the Pentagon, claiming that being fired violates their First Amendment rights.

“Plaintiffs’ real complaint seems to be that they were victims of a cruel bait-and-switch,” Judge McFadden wrote. “They are being fired for giving pre-approved interviews on their paper’s behalf in which they largely toed the company line. Whatever else such a scheme may violate, it does not clearly offend the First Amendment.”

“Plaintiffs’ own pleadings and the CBS News segment suggest that they spoke as part of their official duties and not as private citizens,” the judge’s ruling stated. “They are thus unlikely to succeed on the merits of their First Amendment claim and do not demonstrate irreparable harm. For similar reasons, the balance of the equities favors the Department.”
