Supreme Court Rules Monsanto not Responsible for Lack of Cancer Warning

The majority determined that the EPA approved the label that did not list the danger.

The Supreme Court ruled this week that federal law supersedes state law regarding Monsanto’s lack of a cancer warning on its pesticide labels. The majority opinion determined that the Federal Insecticide, Fungicide, and Rodenticide Act, originally approved by Congress in 1947, placed the Environmental Protection Agency in charge of label contents.

Justice Brett Kavanaugh wrote the opinion that found Monsanto could not be sued for failing to provide cancer warnings, stating, “In sum, federal law requires Monsanto to sell Roundup with the label that EPA approved at the initial registration and that EPA has subsequently re-approved on multiple occasions — that is, the label without a cancer warning.” 

The ruling is expected to motivate legislators in Congress to remove liability protections for the health dangers caused by pesticides.
