The Supreme Court issued a stay that allows the State Department to require the indication of biological sex on U.S. passports. President Donald Trump’s administration updated the previous policy from 2021 that allowed citizens who identify as transgender or nonbinary to choose “X“ rather than “M“ or “F.“
“Displaying passport holders’ sex at birth no more offends equal protection principles than displaying their country of birth,” the court wrote in the unsigned emergency order. “In both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment.”
