The lower chamber has been in recess since before she won the election in late September.
Congresswoman-elect Adelita Grijalva and the state attorney general are suing the House of Representatives for delaying her swearing in. House Speaker Mike Johnson has cited the ongoing government shutdown as the reason for the delay. The House of Representatives adjourned in September after the continuing resolution was passed, before Ms. Grijalva won the election for her late father’s seat.
The state AG and representative-elect seek a court to declare Grijalva a member of the House and allow “any person authorized by law to administer oaths under the law of the United States, the District of Columbia, or the State of Arizona” to administer her oath of office.
“We run the House,” Speaker Johnson responded. “She has no jurisdiction. We’re following the precedent.”
Many new congressional members have experienced similar delays in taking the oath in recent years, for a variety of reasons.
