Representative Nancy Mace of South Carolina filed a resolution late Wednesday to expel Representative LaMonica McIver from the House of Representatives after the New Jersey congresswoman was charged with assault of an ICE agent by the Justice Department. She will not force a vote but allow the House Ethics Committee to review the resolution.
“Members of Congress swear an oath to uphold the Constitution and the laws of this country — not to obstruct them,” Congresswoman Mace stated. “This isn’t a matter of partisan politics. It’s about whether we’re going to hold Members of Congress to the same legal standards as every other American.”
“Assaulting federal agents is a crime, plain and simple. No one is above the law. The American people deserve better,” Representative Mace said. “If any other American did what she did, they’d be in handcuffs. McIver thinks being a Member of Congress puts her above the law. It doesn’t. She should be prosecuted to the fullest extent of the law.“
The resolution cites that Representative McIver “entered a secure area of Delaney Hall Federal Immigration Facility without authorization“ and the physical actions with which she attacked agents. The resolution also recounts that “this conduct by Representative LaMonica McIver was captured on video on body cameras worn by Federal law enforcement and is undisputable.”
Congresswoman Mace cited how former Representative George Santos of New York was expelled from Congress after being charged with criminal offenses but before he was convicted, setting the precedent of expulsion.
