9th Circuit Vacates Injunction Against President’s Collective Bargaining Ban

Federal departments have been directed to reconsider their affiliation with unions. 

The Ninth Circuit Court of Appeals panel overturned a preliminary injunction last week that halted an executive order from President Donald Trump, which ended collective bargaining agreements for departments across the federal government due to security concerns. Six federal employee unions had sued the president’s administration last year over the order, alleging First Amendment violations.

The Office of Personnel Management (OPM) originally informed agencies that they could continue with their current union contracts while the case was pending, but has since advised agencies to amend or even fully cancel their collective bargaining agreements. In response to the executive order, the Department of Veterans Affairs (VA) and others have already made adjustments to their affiliation with unions.
