Education Department Updates Title IX

The final rule strengthens prohibitions on “discrimination on the basis of sex.“

The U.S. Department of Education released a final rule under Title IX that “promotes educational equity and opportunity“ that applies to all elementary and secondary schools as well as postsecondary institutions. The rule seeks to ensure “that no person experiences sex discrimination, including sex-based harassment or sexual violence, in federally funded education.“

The new rule “protects against discrimination based on sex stereotypes, sexual orientation, gender identity, and sex characteristics.“ The department outlined the three regulations regarding discrimination, accountability, and support for students and families.

“These final regulations clarify Title IX’s requirement that schools promptly and effectively address all forms of sex discrimination,” said Assistant Secretary for Civil Rights Catherine Lhamon.

Education officials are still in the rulemaking process for Title IX regulations related to athletics.
