President’s Administration Sued for Offshore Wind Approval

Plaintiffs cite potential whale endangerment in attempted construction block.

President Biden’s administration has been sued by a think tank over the federal approval for America’s largest offshore wind farm. The plaintiff argued that the approval did not take the protection of local right whale populations into consideration, claiming the National Marine Fisheries Service has abdicated “its duty to provide meaningful protection for an endangered species.”

According to data collected by the National Oceanic and Atmospheric Administration (NOAA) between 2017 and 2024, vessel strikes caused the most deaths among right whales in the North Atlantic, 14 of the 39 total deaths recorded. The second most common cause of death was entanglement in fishing gear. In January, President Biden’s administration released a strategy to avoid noise disruptions during turbine construction that could threaten the habitats of the endangered right whale population, of which only 360 remain.
