James David Cain, Jr., was born in November 1964, in Deridder, Louisiana. He earned an undergraduate degree from McNeese State University and received his Juris Doctor from the Southern University Law Center in Baton Rouge. He served three years as a congressional aid in the U.S. House of Representatives. He clerked at the Louisiana Third Circuit Court of Appeals, then entered private practice. 

President Donald Trump nominated Cain to a judgeship at the United States District Court for the Western District of Louisiana. His nomination expired before being acted upon, and President Trump re-nominated him. He was later confirmed by the Senate and received his judicial commission in June 2019. 

In the News…

The State of Louisiana brought suit against the Environmental Protection Agency under the disparate impact requirements of the Civil Rights Act. Under the EPA rule, in areas like the “Cancer Alley” corridor along the Mississippi River, which has different pollution levels from those in predominantly caucasian areas, the state would have to show preference for industry development. The state sought a preliminary injunction to block the EPA from enforcing those rules, arguing that the rule was unconstitutional due to its focus on race and was also a violation of the Clean Air Act. 

Federal Judge James D. Cain, Jr. agreed with the state, blocking the EPA from enforcing its disparate impact rules, along with other measures. 

“The public interest here is that governmental agencies abide by its laws, and treat all of its citizens equally, without considering race,” Judge Cain’s ruling said. “To be sure, if a decision maker has to consider race, to decide, it has indeed participated in racism.” 

He wrote, “Pollution does not discriminate.”
