Second Circuit U.S. Court of Appeals

Eunice Cheryl Lee was born in 1970 at a U.S. Air Force base in Wiesbaden, Germany. Ohio State University is where she received her undergraduate degree and her Juris Doctor was earned at Yale Law School. She clerked at the Southern Ohio U.S. District Court and later at the Sixth Circuit Court of Appeals. 

She worked for six years in the Office of the Appellate Defender in New York City and was also a director of recruitment for them. She was an adjunct assistant professor at the New York University School of Law.  

She was nominated by President Joe Biden to serve on the Second Circuit U.S. Court of Appeals. She was confirmed by the Senate and received her commission in August 2021. 

In the News…

The Second Circuit U.S. Court of Appeals has revived a case that challenged a measles vaccine requirement for schoolchildren in upstate New York. The parents claimed their “sincerely held religious beliefs,” protected by the Free Exercise clause of the First Amendment, had been violated by the schools. Judge Eunice Lee and two other judges stated the district court that previously dismissed the lawsuit must hold a trial. 

In their 23-page opinion, the court reasoned, “Given the fact-intensive nature of this inquiry, Defendants have not met the high bar required to prevail at the summary judgment stage. Contrary to the district court’s holding, we conclude that a reasonable juror could find that Defendants acted with religious animus.”
