Administration Releases New HIPAA Guidelines over Abortion

Rules would expand privacy guidelines.

President Biden’s administration released new patient privacy guidelines, seeking to clarify federal protections for personal medical information that law enforcement officials could use to investigate potential violations of states’ abortion laws.

The new guidelines come in the wake of last week’s Supreme Court decision overturning Roe v. Wade, which has led some states to implement laws limiting or prohibiting abortion. The guidelines were issued Wednesday by the Department of Health and Human Services Office for Civil Rights.

The new guidelines emphasize limits that federal rules place on the disclosure of patient data protected by the health privacy law.
