Chief Justice Orders Investigation Into Leaked Opinion

Marshal of the Court will be in charge. 

On Tuesday morning, Supreme Court Chief Justice John Roberts ordered the Marshal of the Court to investigate who leaked the draft opinion in an abortion case before the nation’s highest court. 

The Chief Justice said, “This was a singular and egregious breach of trust that is an affront to the Court and the community of public servants who work here. I have directed the Marshal of the Court to launch an investigation into the source of the leak.” 

On Monday night, a news article was published stating that Justice Samuel Alito, a member of the court’s majority, had written a draft opinion in a pending Mississippi abortion case that bans the procedure after 15 weeks gestation. In the draft opinion, the court would also overturn the 1973 Roe v. Wade decision recognizing a right to abortion. 

Chief Justice Roberts also wrote, “To the extent this betrayal of the confidence of the Court was intended to undermine the integrity of our operations, it will not succeed. The work of the Court will not be affected in any way.“ 

“We at the Court are blessed to have a workforce — permanent employees and clerks alike — intensely loyal to the institution and dedicated to the rule of law. Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court.” 

He also said the document described in the published article is “authentic.” “However,” he said, “it does not represent a decision by the Court or the final position of any members on the issues in the case.”
