Attorneys argue over binding power of reatification deadline

With Virginia’s recent ratification of the Equal Rights Amendment, the 38 states necessary to amend the U.S. Constitution are finally present and brought together, 38 years after the ratification deadline. Proceedings are complicated by attorneys who are contesting the deadline while still others uphold it.

After asking the archivist of the United States, David Ferriero, to rule whether or not the original ratification deadline of 1982 was still binding, he said that he would “take no action to certify the adoption of the Equal Rights Amendment.” The pro-ERA attorneys sued Ferriero for his ruling, while those who support enforcement of the long-passed deadline emphasize their opposition to the amendment.
