District Judge Lance Walker denied a legal filing by Maine Family Planning on Tuesday that requested a temporary block of the suspended Medicaid reimbursements for providers that also perform abortions.
While Medicare coverage for abortion was already prohibited, the One, Big, Beautiful Bill Act, passed by Congress on July 4, adjusted federal law to prohibit Medicaid funding for other procedures by medical facilities that provide abortions.
Maine Family Planning sued President Trump’s administration over the updated law, since the clinic faces the closure of its facilities without Medicaid funding.
Judge Walker determined that the act was passed by Congress, not the president’s administration. “Congress is entitled to withhold federal funds and otherwise disassociate from conduct that is not enshrined as a constitutional right,” Judge Walker wrote in his ruling.
