Supreme Court Lifts Temporary Pause on Federal Mass Firings

The president directed federal agencies to make reductions in force “consistent with applicable law.”

The Supreme Court issued an unsigned order this week that lifted a temporary pause on the mass firing of thousands of government employees by President Trump’s administration. This was a response to an emergency appeal filed by the administration, citing that the order directs agencies to act “consistent with applicable law.“

“The plans themselves are not before this Court, at this stage, and we thus have no occasion to consider whether they can and will be carried out consistent with the constraints of law,” wrote Justice Sonia Sotomayor in her concurrence alongside the majority. She stated that the decision does not impede courts from hearing lawsuits challenging specific reductions in force.

Justice Ketanji Brown Jackson was the only justice to dissent from the order.
