SCOTUS Orders Rehearing of Religious Freedom Case over NY Abortion Law

The ruling is consistent with a prior decision regarding the First Amendment and Catholic organizations.

The Supreme Court ordered the New York Court of Appeals to rehear a case brought by religious organizations, including the nuns from Little Sisters of the Poor, challenging the state’s mandate requiring all employer-sponsored healthcare to cover abortions. The original state law had offered broad religious exemptions, but those were narrowed after lobbying by abortion advocates.

The Supreme Court ordered the case’s reconsideration after ruling in favor of the Catholic Charities Bureau earlier this month against the state of Wisconsin. In that ruling, the Supreme Court said that the state could not deny the Catholic organization’s religious exemption from an unemployment insurance program. 

In the Wisconsin case, the justices found that the state did not adhere to “the First Amendment’s protection for religion and discriminated against the religious organization in Wisconsin.”

The high court stated in the case against New York, “The petition for a writ of certiorari is granted. The judgment is vacated, and the case is remanded to the Court of Appeals of New York for further consideration.”
