Judge Suspends DHS From Revoking Harvard’s Student Visa Program

The block on the enrollment of foreign nationals was announced by President Trump’s administration the day before.

On Friday, District Judge Allison Burroughs ruled in Harvard’s favor implementing a temporary restraining order to stop the Department of Homeland Security from revoking its student visa program less than a day after the president’s administration invoked the program’s halt. 

In its lawsuit filed in federal court in Boston, Harvard claimed the government’s action violates the First Amendment and will have an “immediate and devastating effect for Harvard and more than 7,000 visa holders.”

Judge Burroughs implemented the block of the president’s administration action while the case proceeds to prevent the enforcement of the ban on foreign enrollment until the lawsuit has been resolved.

“It is a privilege, not a right, for universities to enroll foreign students and benefit from their higher tuition payments to help pad their multibillion-dollar endowments,” said DHS Secretary Kristi Noem at the time the visa revocation was announced on Thursday. “Harvard had plenty of opportunity to do the right thing. It refused. They have lost their Student and Exchange Visitor Program certification as a result of their failure to adhere to the law.”

Regarding the suspension of the enrollment of foreign nationals, Secretary Noem stated, “This administration is holding Harvard accountable for fostering violence, antisemitism, and coordinating with the Chinese Communist Party on its campus.”
