Federal Judge Blocks Education Department Layoffs

He ruled the reduction in force violates the separation of powers.

District Judge Myong Joun issued a preliminary injunction blocking President Donald Trump’s administration from terminating some employees within the Department of Education.

In March, the president ordered the Education Department to cut nearly 50 percent of its workforce as a reorganization of a federal agency. While the executive order did note that only Congress could enact permanent change to the department’s workforce requirements, Judge Joun ruled that there was no indication that the administration was pursuing congressional solutions. The judge ruled that the administration violated the balance of power mandated by the Constitution.

“Not only is there no evidence that Defendants are pursuing a ‘legislative goal’ or otherwise working with Congress to reach a resolution, but there is also no evidence that the [“reduction-in-force”] has actually made the Department more efficient,” Judge Joun wrote. “Rather, the record is replete with evidence of the opposite.”
