Supreme Court Upholds Traffic Stop Ruling

Police can pull over vehicles under the suspicion that the person driving is the owner of the vehicle. 

On Monday, the Supreme Court issued its opinion in the case of Kansas v. Glover. The 8-to-1 ruling was in favor of the Kansas police officer who pulled over a vehicle on the suspicion that the driver was the owner of the vehicle and therefore driving on a suspended license. Glover had argued that the stop was an example of an improper stop and search. 

The ruling holds up the stop and paves the way to allow such stops in the future as long as there is no reason to dispute the hunch that the driver is the owner of the car. According to the opinion written by Justice Clarence Thomas, “We hold that when the officer lacks information negating an inference that the owner is the driver of the vehicle, the stop is reasonable.”
