Ninth Circuit U.S. Court of Appeals

Susan Pia Graber was born in July 1949 in Oklahoma City, Oklahoma. She earned an undergraduate degree from Wellesley College and received her Juris Doctor from Yale Law School. 

She was an assistant attorney general for the New Mexico Bureau of Revenue, before entering private practice in Santa Fe, New Mexico. She was in private practice in Ohio and later in Portland, Oregon. She was a mediator for the United States District Court for the District of Oregon. She was appointed by the governor to the Oregon Court of Appeals, where she served seven years.  She was later appointed to the Oregon Supreme Court. 

President Bill Clinton nominated Graber to the United States Court of Appeals for the Ninth Circuit. She was confirmed in a 98-0 vote of the Senate and received her commission in March 1998. 

In the News…

By a 7-4 vote, the Ninth U.S. Circuit Court of Appeals rejected claims by gun rights advocates that California’s 2017 ban on magazines with more than 10 rounds of ammunition violated their right to bear arms under the Second Amendment of the U.S. Constitution and constituted an unconstitutional taking. 

In August 2020, a three-judge panel of the same court sided with a lower court judge who struck down the ban, saying it was “well-intentioned,” but interfered with the constitutional right to armed self-defense. The appeals court set that ruling aside in February 2021, so the dispute could be considered by an 11-judge panel. 

Writing for the majority, Chief Judge Susan Graber said the ban was a “reasonable fit for the important government interest of reducing gun violence” and interfered “only minimally” with the right to self-defense.
