Federal Judge Overturns Assault Rifle Ban

Calls three-decades-old ban unconstitutional.

U.S. District Judge Roger Benitez of San Diego overturned a California ban on assault rifles that has been in place for thirty years. The judge’s decision last week stated the state’s law is unconstitutional and deprives its citizens of the lawful right to bear arms and that “under no level of heightened scrutiny can the law survive.”

Judge Benitez ruled regarding the state’s definition of military-style firearms, “This case is not about extraordinary weapons lying at the outer limits of Second Amendment protection. The banned ‘assault weapons’ are not bazookas, howitzers, or machine guns. Those arms are dangerous and solely useful for military purposes.”
