Judge P. Kevin Castel, Southern New York U.S. District Court

Judge P. Kevin Castel

Southern New York U.S. District Court

Peter Kevin Castel was born in 1950 in Jamaica, New York. He earned his undergraduate degree from St. John’s University and his Juris Doctor from St. John’s University School of Law. He clerked for a judge on the Southern New York U.S. District Court. He entered private practice.

President George W. Bush nominated Castel in March 2003 to serve as a federal judge on the United States District Court for the Southern District of New York. The Senate confirmed him and he received his judicial commission in September 2003. He assumed senior status in August 2017.

In the News…

U.S. District Judge Kevin Castel ruled that New York’s climate superfund law, which sought to charge fossil fuel companies for their alleged role in climate change, was unconstitutional. His decision permanently blocked enforcement of the state law.

Judge Castel determined that the Department of Justice had standing in its claim that the New York Climate Act “impinges on [the federal government’s] sovereign authority to create laws relating to the emission of greenhouse gases and to enforce those laws against violators and to declare and promote its interests in foreign affairs.”

The judge wrote, “The court also concludes that the United States has demonstrated that New York’s Climate Act intrudes upon these interests and is therefore preempted.”
