Today, the Supreme Court is hearing oral arguments in two cases.
The justices will consider, in Maxwell v. Dinis, whether disputes over an inmate’s First Step Act time credits may be determined under certain U.S. statutes and whether the obstruction of the administrative remedy of the request creates an issue for a jury or trial court.
In the second case, the justices will be determining whether defendants may assert an affirmative defense as the basis for a summary judgment without amending or seeking to amend a previous answer that did not include an affirmative defense plea.
