The rule highlights federal court decisions that struck down the previous inclusion of transgender students under the federal rule.
The U.S. Department of Education announced the final rule that formally rescinded the 2024 regulation that amended Title IX of the Education Amendments of 1972 (Title IX). The action reinstates the 2020 Title IX rule in the Code of Federal Regulations under President Trump’s first administration that clarifies guidance for parents, students, and educational institutions on the legal requirements of Title IX.
Secretary of Education Linda McMahon said, “The published Title IX regulations faithfully reflects court orders and Congressional intent—reducing confusion for parents, students, and educational institutions. We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls.”
The Education Department explained, “Title IX of the Education Amendments of 1972 prohibits discrimination on the basis of sex in any education program or activity receiving federal financial assistance. This includes female students’ rights to single sex bathrooms and locker rooms, and competitive athletic competition restricted to biological female athletes.“
