Judges are hearing the claim that receipt of mifepristone via mail violates Louisiana’s abortion laws.
A panel of federal Judges in the 5th U.S. Circuit Court of Appeals heard arguments surrounding the prescribing rules for mifepristone, a drug most commonly used for abortions in the United States. This is one of three current lawsuits involving the prescription guidelines for mifepristone. In this case, the State of Louisiana is arguing that allowing providers in legal-abortion states to mail the medication to women in Louisiana violates the state’s abortion laws.
The U.S. Food and Drug Administration (FDA) is conducting a safety review regarding the use of mifepristone, and proceedings on the case have been put on hold until the review is complete. A district court judge issued a deadline for the status update for Oct. 7, but officials are uncertain how detailed the update will be by that date.
The case is expected to eventually reach the Supreme Court, which will not be the first time it hears arguments about the use of mifepristone.
