The state supreme court had ordered that the 2022 map be used in a separate case.
Eastern District of Missouri Chief Judge Stephen Clark ruled this week that the state of Missouri must use the updated congressional district maps that were approved by the state supreme court and used in the primary election for the November midterms. The judge stated that those who already cast their votes in the state’s primary would be disenfranchised.
“Disenfranchising voters across the state and denying them their constitutional right to have their primary votes counted significantly harm the public interest,” Judge Clark wrote. “Using a different map for the general election would wreak havoc on the fairness and orderliness of Missouri’s congressional elections, calling into question the candidacy of those nominated in the primaries and the votes of those who voted in the primaries. Widespread voter confusion would inevitably follow.”
The Missouri Supreme Court ordered in a separate case that the map from 2022 must be used since the redistricting was not approved via referendum. U.S. Supreme Court Justice Brett Kavanaugh declined an appeal of the state high court’s decision by the state’s attorney general.
