Stephen Patrick McGlynn was born in 1962 in East St. Louis, Illinois. He earned an undergraduate degree from the University of Dayton and received his Juris Doctor from Saint Louis University.

McGlynn entered private practice. He served as Special Assistant Attorney General of Illinois, and later as General Counsel of Kaskaskia Regional Port District. He was appointed as a justice of the Appellate Court of the 5th Judicial District by the Illinois Supreme Court in 2005. Five years later, he was appointed as a judge in the St. Clair Circuit Court.

President Donald Trump nominated McGlynn to the Southern Illinois U.S. District Court in December 2019. The Senate confirmed him, and he received his commission in September 2020.

In the News…

Federal District Judge Stephen McGlynn granted the Department of Justice’s motion for summary judgment and denied Illinois’ motion to dismiss in the case of state laws giving financial support to illegal foreign nationals. The judge found that Illinois’ RISE Act and the DREAM Act are “unconstitutional and invalid” as they apply to illegal aliens.

Judge McGlynn determined that the laws violated federal law by providing in-state tuition, financial aid, and scholarships to illegal immigrants while refusing those benefits to U.S. citizens who live in other states.  

While Judge McGlynn’s order prohibits the state from enforcing the laws, he allowed a 14-day span for Illinois to appeal to a circuit court before the ruling takes effect.
