President Announces Pharmaceutical and Metals Tariffs After National Security Review

His plan sets tiered drug duties tied to domestic production and revises steel, aluminum, and copper import calculations.

President Trump issued a proclamation last week imposing new tariffs on certain patented pharmaceuticals and related ingredients after a Commerce Department investigation concluded that heavy reliance on foreign production could affect national security and supply stability. The plan establishes a 100 percent tariff on covered imports, with a reduced 20 percent rate for companies that commit to shifting manufacturing to the U.S. and a temporary zero-tariff option for firms negotiating or implementing “most favored nation” pricing agreements with the U.S. Department of Health and Human Services (HHS).

Generic drugs, biosimilars, and some specialty treatments are excluded, while products from the European Union (EU), Japan, South Korea, Switzerland, and the United Kingdom (UK) face lower rates under trade arrangements. The order directs the Commerce and HHS secretaries to continue negotiating onshoring and pricing agreements, monitor compliance, and reassess whether additional actions are needed. Officials cited data showing a significant share of patented drugs and active ingredients are produced abroad and said the policy plans to encourage domestic manufacturing and reduce supply vulnerabilities.

In a separate but related action, the administration also revised tariffs on imported steel, aluminum, and copper and finished goods containing those metals. Raw materials remain subject to a 50 percent duty applied to the full import value, while products containing more than 15 percent of those metals face a 25 percent tariff on the total price. Items below that threshold are exempt. The administration said the changes are intended to address underreporting of metal content and close loopholes in prior rules. The order also authorizes expanded coverage of derivative products and maintains higher penalties for certain sources, while directing agencies to review impacts and report back.
