Transportation Secretary Proposes Expanded Domestic Content Rule for EV Chargers

Buy America waiver modification would raise requirement to 100 percent

U.S. Transportation Secretary Sean Duffy announced a proposal to modify the Buy America waiver governing federally funded electric vehicle (EV) charger projects. The change would increase the required domestic content threshold from 55 percent to up to 100 percent for charger components manufactured with Federal Highway Administration (FHWA) funds. The proposal would apply during acquisition and installation phases once finalized.

The modification updates a waiver issued in 2023 and aligns with revised guidance for the National Electric Vehicle Infrastructure program. 

“We’ve already updated the guidance, slashed red tape, and made it easier for states to efficiently build out this infrastructure – delivering nearly double the amount of charging ports,“ said Secretary Duffy. “Now we’re ensuring that if Congress wants to see these chargers built, we put America First. Doing so will unleash American manufacturing, protect our national security, and prevent taxpayer dollars from subsidizing our foreign adversaries.”
