Third Circuit Overturns Ruling to Release Palestinian Activist

The panel found the district judge lacked jurisdiction to issue such an order.

The Third Circuit U.S. Court of Appeals overturned a district court judge’s order for the federal government to release Palestinian activist and former Columbia student Mahmoud Khalil.

The activist, who had led anti-Israel protests on college campuses after Hamas attacked Israel on October 7, 2023, had been detained by U.S. Immigration and Customs Enforcement (ICE) and was in the process of being deported. The federal judge had ordered his release from a facility in Louisiana last summer.

The Third Circuit panel of judges determined the district judge lacked jurisdiction, since petitions against deportation are required by immigration law to be filed with a federal appellate court.
