The decision overrules California law requiring teachers to hide children’s gender expression from parents.
District Judge Roger Benitez determined that federal law allows school employees to inform parents of a student’s “gender incongruence” and cannot be forced to conceal such information. The recent ruling states that federal law will protect teachers who choose to inform parents of their children’s gender identity expression at school. California appealed the decision the same day it was issued.
Judge Benitez wrote, “Because the State Defendants’ parental exclusion policies… demand that teachers communicate misrepresentations or deceptively avoidant responses to parental questions, which, in turn, violate the constitutional rights of parents, this type of government speech may not be forced upon teachers who conscientiously disagree.”
The case was filed on behalf of two California public school teachers who objected to their school district’s policies, which barred teachers from revealing matters connected to a student’s gender identity to parents, including alternative pronouns or names used at school.
