FDA Warns Retailers After Recalled Infant Formula Remains on Store Shelves

The agency cited gaps in recall compliance during an investigation tied to infant formula botulism cases.

The Food and Drug Administration (FDA) recently issued a reminder to food retailers and distributors about their legal obligations during product recalls. Warning followed findings that recalled ByHeart infant formula remained on store shelves for weeks after a voluntary recall was issued due to the product being connected with cases of botulism. FDA investigators and state partners conducted more than 4,000 retail checks nationwide and found recalled products still available in over 175 locations across 36 states.

The agency sent warning letters to several major retailers, citing failures to promptly remove recalled infant formula intended for infants and young children. The FDA has asked retailers to respond within 15 days to outline corrective actions. 

“Food safety is a shared responsibility, and it is of utmost importance that all parties in the supply chain act swiftly and vigilantly to protect our nation’s children from unsafe food,” said FDA Commissioner Marty Makary.

The agency stated that federal officials are working with federal, state, and local partners to strengthen recall communication and enforcement, particularly for products affecting vulnerable populations.
