U.S. Appellate Court Upholds Free Speech Protections for NY Pregnancy Centers

The court found that pregnancy centers have the right to share information about progesterone with women.

The Second Circuit U.S. Court of Appeals issued a ruling this week that pro-life pregnancy centers in New York are legally allowed to tell women about the use of progesterone to potentially reverse the effects of the abortion pill. The court ruled that crisis pregnancy organizations have the right to share this information with women under the First Amendment. 

New York Attorney General Letitia James sued the organizations last year, claiming that they were spreading “false and misleading” information in violation of the state’s business fraud laws. The court found that the pro-life centers were merely disseminating information without a commercial benefit. Also, multiple studies have shown that using progesterone may safely and effectively reverse the effects of the abortion pill mifepristone.

This lawsuit is ongoing, but the court’s ruling allows pregnancy centers to continue to share information about the use of progesterone while proceedings continue.
