Federal Judge Rules President Cannot Deploy National Guard to D.C.

President Trump’s administration has appealed the ruling.

District of Columbia Federal Judge Jia Cobb ruled that President Donald Trump illegally deployed the National Guard to Washington, D.C. She placed a 3-week hold on the ruling to allow for appeal.

Judge Cobb wrote, “While the President certainly may have some Article II powers to protect federal functioning and property, including in the District, such powers cannot justify the deployment of the DCNG [DC National Guard] in this case.”

“At its core, Congress has given the District rights to govern itself. Those rights are infringed upon when defendants approve, in excess of their statutory authority, the deployment of National Guard troops to the District,” Judge Cobb wrote.

The judge also added that D.C. “suffers a distinct injury from the presence of out-of-state National Guard units” because “the Constitution placed the District exclusively under Congress’s authority to prevent individual states from exerting any influence over the nation’s capital.”

She continued, “The Court finds that the District’s exercise of sovereign powers within its jurisdiction is irreparably harmed by Defendants’ actions in deploying the Guards.” 

The president deployed the guard troops to the District of Columbia in August and crime numbers reportedly dropped to almost half for the following three weeks.
