The department sent a letter outlining the application for the ability to opt out of certain programs without waivers.
The Education Department sent a letter to all chief state school officers reminding them that they may apply for authority under the Education Flexibility Partnership Act of 1999 (Ed-Flex Act). The option allows states to waive certain federal requirements in districts and schools to better serve the local community.
The letter outlined how the authority allows states to opt out of prevention and intervention programs for neglected, at-risk, or delinquent youth, effective instruction support, and the education of migratory children.
“As we return education to the states, we are hopeful the Ed-Flex authority will be more widely used to better meet students’ unique learning needs,” said Acting Assistant Secretary for the Office of Elementary and Secondary Education Hayley Sanon.
