Appeals Court Blocks Firing of Fed Governor Lisa Cook

Issues an emergency ruling stating the government must follow due process.

The D.C. Court of Appeals issued an emergency ruling on Monday that determined President Donald Trump cannot fire Federal Reserve Governor Lisa Cook because it did not uphold her due process protections.

“The government does not dispute that it failed to provide Cook even minimal process – that is, notice of the allegation against her and a meaningful opportunity to respond – before she was purportedly removed,” the three-judge panel wrote in its opinion. “Granting the government’s request for relief when Cook has received no meaningful process would contravene that principle.”

President Trump attempted to fire Cook from the Federal Reserve last month due to allegations of mortgage fraud. Cook’s lawyers allege that these allegations are not a good enough reason to fire her “for cause.” The emergency ruling came just ahead of the Federal Reserve board’s quarterly meeting.
