Judiciary Chair Calls for Prosecution of Former Special Counsel

Communications from members of Congress were collected alongside President Trump’s future chief of staff.

House Judiciary Committee Chair Jim Jordan of Ohio again called for former Special Counsel Jack Smith to be prosecuted for allegedly lying to Congress regarding the monitoring of President Trump’s future Chief of Staff, Susie Wiles, in 2023. The White House Government Transparency Task Force released documents, declassified by President Trump this week, revealing the ways the special prosecutor’s team tracked phone calls during an investigation into President Trump’s alleged mishandling of classified documents.

The House Judiciary Committee concluded last month that Smith’s team “disregarded the separation of powers to spy on their political opposition” by secretly collecting communications from federal legislators and “violated the Constitution’s Speech or Debate Clause, a core provision that protects the official actions and communications of Members of Congress and immunizes them from prosecution for legislative acts.”

Senator Chuck Grassley, chair of the Senate Judiciary Committee, stated that Mr. Smith’s response before his committee “was highly evasive and misleading, at minimum.“ Senator Josh Hawley of Missouri called for Smith’s disbarment after he appeared before the Senate committee.

Senator Marsha Blackburn of Tennessee, one of the legislators whose phone records were tracked by Smith’s team, has filed a federal lawsuit against the former special counsel.
