President Trump commends the court’s ruling.
The U.S. Court of International Trade determined on Thursday that President Trump had the authority to rescind the “de minimus” exemption, a policy that allowed items valued at or under $800 to be imported duty-free.
The court ruled, “IEEPA [International Emergency Economic Powers Act of 1977] authorizes the President’s rescission of the de minimis exemption. We further hold that, pursuant to controlling Supreme Court precedent, any agency actions here implementing the President’s directive are ministerial in nature and therefore not reviewable under the APA [Administrative Procedure Act].”
President Trump commended the court’s decision, stating, “For years, Foreign Shippers could send packages worth up to $800 into our Country, DUTY FREE, NO TARIFF, far less scrutiny. It became a giant loophole for TARIFF Cheats — and a Pipeline exploited by Fentanyl Traffickers, Counterfeiters, and other Criminals shipping dangerous and illegal products into America.”
The president continued, “America is now SAFER, our Workers are better protected.” He highlighted that tariff revenue could support the U.S. military, tax relief, and law enforcement, among other priorities.
