Court reverses conviction in case challenging district firearm law

The District of Columbia Court of Appeals ruled that a united law banning firearm magazines capable of holding more than ten rounds violates the Second Amendment. The decision reversed the conviction of Tyree Benson, who had been arrested in 2022 for possessing a handgun with a 30-round magazine. Writing for the majority, Judge Joshua Deahl stated that such magazines are widely owned in the United States and therefore fall within the category of arms commonly used by law-abiding citizens.

“Because these magazines are arms in common and ubiquitous use by law-abiding citizens across this country, we agree with Benson and the United States that the District’s outright ban on them violates the Second Amendment,” Judge Deahl wrote on behalf of the majority of the divided panel.

The court also vacated related convictions tied to the firearm possession charges because they were linked to the magazine restriction. District of Columbia officials may seek further review of the decision through a larger appellate panel or by appealing to the Supreme Court of the United States.
